If you are receiving Worker's Compensation benefits and Social Security Disability like so many people injured up until three years ago the law was clear that you could settle your Worker's Compensation case and count on Medicare to pay for the treatment that was no longer going to be available through their Worker's Compensation carrier now that you have settled. So that everybody was happy and everyone was covered. Apparently Social Security Disability figured that they were being dumped upon by all these Worker's Compensation cases throughout the United States. The individual would take their money from the settlement and simply start sending bills to Social Security Disability and Medicare. The rules have been changed. This no longer is permitted. If a Worker's Compensation victim wishes to settle their case and they are receiving Medicare there is a whole series of communications that must occur, approvals that must occur, and it becomes a very precarious situation for an individual to try to handle by themselves.
