It has been my experience that although the insurance company doctor and sometimes even the callous adjustor or the defence attorney of the insurance company will allege that somebody is malingering their injury which malingering means that they are just sitting home waiting for jackpot justice. There is no such thing as jackpot justice in Workmen's Compensation.
The settlement numbers can be significant pale in comparison to what somebody can earn in America as a working person. So my experience has been that nobody really wants to sit home and do nothing. In fact if the idea of work didn't exist I think man would invent it. Man is not meant, and I mean "man" in the broadest sense man meaning mankind, is not meant to just sit home and do nothing. So when the opportunity comes I would say 99 percent of the time in our practice that the settlements are fair. The offers are fair and the client really loves what we do for them in fighting the battle against the insurance companies.
