The Workers Compensation Benefit Rate for Partial Disability in Pennsylvania

The benefit rate is equal to two-thirds of the difference between the pre-injury average weekly wage and the "earning power" after the injury.

The worker and the insurance company through a Supplemental Agreement for paying a "predicted" or "estimated" payment for 13 weeks, and then adjusting this at the end of the quarterly period can agree upon this benefit.

In order to receive these benefits, there must be a loss in earning capacity. The earning power of the employee includes his or her right to earn overtime, vacation pay and profit sharing. For seasonal work schedules, the rate is averaged out over 52 weeks.
