HOME QUALIFING FOR WORKERS COMP DENIED OR TERMINATED CLAIMS FILING A CLAIM ARTICLES HIRING A LAWYER

rhinoYamaha Rhino ATV is in the news because it has had problems rolling over and ejecting passengers.

Yamaha Rhinos are more likely to be involved in rollover accidents than other ATVs.  This tends to occur, even at slower speed, when making turns.  Rollover accidents are very dangerous.  They result in severe injuries and wrongful deaths. The primary cause of the Yamaha Rhino problem is the narrow wheelbase and small wheels.

What has Yamaha done to correct this problem?  They could have issued a recall.  Instead, Yamaha is trying to get away with just making modifications.  They claim that if doors are added to the ATV, it is safe enough.  Then, passengers would have handholds in place to hold onto while the vehicle rolls.

Is this enough?  We don't think so.  The suggested modifications will not stop the Yamaha Rhino ATV rolling over.  They merely trap the occupant in the ATV as it rolls over.  Serious injury or death could still occur if a rollover happens.

Are Yamaha's the only ATV to have this problem?  No!

Flaws in the design of many ATVs are at the heart of the problem—a large number of serious injuries.  Many lawsuits have been filed and it is expected that Yamaha could face hundreds of these claims.

If you have been injured in a and ATV rollover accident, consider contacting the Bulldog Lawyers at Shor Levin.

How do I hire a lawyer? Here are a few things to consider in hiring a lawyer for your case:
  1. Get references.  Does the lawyer have a good reputation?
  2. Check with the state bar association to make sure that the attorney's license is active and that there are no ethical disputes pending.
  3. Consider whether they are willing to handle your case on a contingent fee basis and to front all costs of litigation to the extent permitted in your state.
  4. Discuss the costs of litigation with the lawyers you are considering.
  5. Ask qustions, lots of questions.  Interview the lawyer to find out what experience they have with similar cases.
  6. Ask how long your case could take.  Most legal proceedings take years.  Be prepared to be in this for the long haul.
  7. Make sure you trust your lawyer.  A good relationship is important since this is a long term commitment that you are entering.
  8. Choose carefully.  Look for experience, passion, and compassion.
